Florida Mirena IUD Lawyers

Our Florida attorneys are investigating Mirena IUD claims.  Mirena is an intrauterine device (IUD) used by millions of women to prevent pregnancy by emitting hormones after implantation.  The Mirena IUD, which is manufactured by Bayer Pharmaceuticals, was approved by the FDA in 2000 for intrauterine contraception and in 2009 for the additional indication of heavy menstrual bleedings.  It is inserted into the uterus and is approved to remain implanted for up to five years after insertion.

The device consists of a small, T-shaped container of flexible plastic which releases continuous doses of the hormone, levonorgesterel, most commonly found in oral contraceptives.

Life Threatening Side Effects

Our Florida Mirena IUD lawfirm is currently investigating MIRENA IUD lawsuits.  There have been more than 45,000 adverse events reported from the use of Mirena IUD, including device expulsion, device dislocation and vaginal hemorrhage.  It is also believed that the device can travel into the abdominal cavity and potentially puncture the bladder or intestines.  Complications related to the Mirena IUD include:

  •  Life-threatening ectopic pregnancy
  •  Perforation of the uterine wall
  •  Pelvic Inflammatory Disease (PID)
  •  Spontaneous migration of the device outside the uterus
  •  Expulsion of the Mirena IUD
  •  Infection
  •  Intestinal obstruction
  •  Organ damage

Depending on the extent of damage, a complete hysterectomy may be required.

Manufacturer Deceived Women

In 2009 the FDA warned that Bayer made misleading claims about the safety and effectiveness of Mirena, claiming the device’s ability to make women feel more intimate and romantic, while ignoring the potentially dangerous complications that might injure the women who use it.  One such marketing campaign known as “Mirena Simple Style” targeted “busy moms” and suggested that Mirena would increase the level of intimacy, romance and emotional satisfaction for women, despite known reports during clinical trials that some participants experienced decreased libido after use.  Mirena marketing also suggested that the IUD would help women “look and feel great”, despite known side effects such as weight gain, acne, breast tenderness and pain.

Our attorneys believe that Bayer’s false and misleading promotional statements withheld information about the risk of uterus perforation, migration and other debilitating problems and unnecessarily exposed women to a risk of injury without providing them an opportunity to decide whether the benefits of a long-term, reversible birth control justified the dangers associated with Mirena.

Additional claims being investigated by Bernheim & Dolinsky attorneys against Bayer regarding its Mirena IUD include:

  •  Misrepresenting the benefits of Mirena
  •  Failure to warn about dangerous side effects, including spontaneous migration of the device
  •  Understating the product’s complications as “uncommon”
  •  Failure to provide adequate warnings and instructions
  •  Producing and knowingly selling and distributing a defective product
  •  Designing a defective product
